Welcome, and thank you for choosing Icake Balloons
These Terms and Conditions serve as a contract between the customer and Icake Balloons. When the customer pays the requested invoice or makes a deposit, the customer is agreeing to all the terms and conditions described below. The terms and conditions are subject to changes periodically without notice.
Booking
All sales are final and non-refundable. Any request for a refund or store credit will be submitted in writing to info@icakeballoons.com and only can be issued by Icake Balloons. After such request is submitted, Icake Balloons will send the outcome to the customer via e-mail in 10 days, during this time Icake Balloons will review the petition and determine an outcome.
The initial payment reserves your event date, the 50% of the total order amount is non-refundable and non-transferable, this amount is not applicable to credit store or at later events, or orders. When you make an order automatically closes the date to any new orders, declining any request for the same date, chances to re-book the date are smaller as the event date gets closer.
Pick-Ups
If the customer elects to pick up the order of cakes or balloons, the customer is responsible for all the components of the order handed to the customer at the location. The customer is responsible to inspect and approve the cake and or balloons handed to him on location, after the customer leaves, Icake Balloons will not be responsible for popped balloons, fly-away balloons, cake accidents, or damages on the customer commute.
Deliveries
The delivery date and time are scheduled by the client at the moment of the check-out.
Rescheduling delivery time can be requested in writing to info@icakeballoons.com until 24 hrs before the day of the event and availability is not guaranteed, most likely there are other events already scheduled the same day. No request for a delivery time will be accepted within 24 hrs of the event, Icake Balloons will attempt the delivery at the originally scheduled time, if nobody is available on location at the scheduled time, the customer is responsible for the cake pick-up at the location that Icake Balloons might set.
On the date of the delivery the customer needs to have an appointment person present at the established location of the event to receive the order, no orders will be left unattended, if the customer request that the order be left unattended at any location, the customer will be completely responsible for the order, Icake Balloons will not be responsible for any damage, if it is lost, stolen or weather mishap or accidents of nature. The customer or responsible appointment person will be on location at the previously established time, Icake Balloons will wait for a courteous 15 minutes on-site, after this time, the customer is responsible for the order pick-up at any location established by Icake Balloons, the customer may also request a re-attempt of delivery, it is subject to availability of Icake Balloon of the requested delivery date, and will incur in an additional delivery charge of no more than the original delivery amount.
Cancellations
If the customer cancels the order 10 days or more before the event will receive a refund of 50% of the total amount of the order, as explained in the booking section.
If the customer cancels the order within 72 hours of the event, will NOT receive any refund or store credit, being that close to the event date, all materials have been set apart, ordered, or bought and preparation for the event is already started.
If the customer cancels within 48hrs of placing the order will receive a full refund.
Rescheduling
All rescheduling will be requested at least 10 days prior to the event to avoid any charges, and the rescheduling date will be no later than 90 days of the original event date and is can not be guaranteed, there might be other events orders already scheduled on that day. If you request to reschedule within 10 days before the event, it is subject to the availability of Icake Balloons for the next date and you will incur an additional charge of 25% of your total order amount.
Changes
All the requests for changes to balloons orders will be submitted in writing to info@icakeballoons.com and have to be within 48hrs of placing the order.
Any changes to an already existing order may inquire in additional charges and Icake Balloons can not guarantee the availability of the requested changes to the original order. No changes to colors or themes will be accepted within 14 days of the event.
All the requests for changes to cake orders, including design, theme, fondant figurine, size, coating, flavor, will be submitted in writing to info@icakeballoons.com and needs to be done within 48 hours of placing the order to avoid additional charges and guarantee availability.
You may request a change of cake flavor and coating up to 7 days before the event date without any charges, no request for changes will be accepted within 7 days of the event, Icake Balloons will provide the originally requested flavor and coating.
Designs may vary
Petitions made by customers by providing an image or photo of a product, Icake Balloons will attempt to match colors, design, shapes to the best of our abilities. Icake Balloons can't replicate a design or image matching at 100%. We work art, and it may vary in shapes, color tones, size, proportions, may be subject to variations or inspiration of the artist.
Site and venue conditions
At the moment of the delivery, the site where the cake will be placed needs to be set, in a safe table or cake stand, such table or stand needs to be stable, solid, leveled, sturdy. Once the cake is set up, it should not be handled or moved until is served. Icake Balloons is not responsible for cake damages caused by anything after the cake has been set up. Cakes are not designed to be outdoors or at extreme temperatures, heat will compromise cake integrity, will soften the sugar, and damage the design. Icake Balloons will not be responsible for cakes left outdoors or exposed to heat.
Balloons Installations
The date, place, and time will be scheduled at the moment of the order placement and paid. At the time of the scheduled installation, someone has to be available to receive the installer. The place on-site where the balloon decoration will be installed needs to be free of obstructions, previously set, and ready for installation. If at the time of the scheduled installation there is no one at the site or the place is closed, Icake Balloon will wait a courteous 25 minutes on-site, after this, the customer is responsible to reschedule an installation time subject to Icake Balloons availability, and may incur in an additional charge. If the customer decides to pick up the balloons will be subject to Icake Balloons availability to set up a pick-up location and time. The customer will be responsible to install the balloon decoration on its own.
Weather
Icake Balloons is not responsible for nature or weather's phenomenons that may affect the scheduled pick up or delivery date. In case of foreseeable weather changes like storms, that may be announced in advance up to 3 days, the customer may request a rescheduling date in writing to info@icakeballoons.com without charge, rescheduling date will be no later than 90 days of the original event date and is subject to availability of Icake Balloons. If no such request is placed it will be handled like a cancellation without prior warning and no refund will be given by Icake Balloons. In case of an unforeseeable weather emergency the same day of the event or up 3 days prior, Icake may issue store credit for the total amount, will notify the customer by email or phone call, and work with the customer to reschedule the event no later than 90 days of the original event, and will void the original contract.
Cancellation without previous notice by Icake Balloons waiver
In case of an unforeseeable circumstance that may prevent Icake Balloons from fulfilling the scheduled event, like an accident, illness, or severe weather outside Icake Balloons control, this contract may be voided.
Food Waivers
The cakes, cupcakes, and products prepared by Icake Balloons may contain or come in contact with milk, eggs, wheat, colorants, nuts, soy, and other food allergens. The customer is responsible to be aware of this and of notifying the guests before serving the cakes or cupcakes. Icake Balloons is not responsible for any adverse effects or allergic reactions.
Fresh Flowers
It is acknowledged by Icake Balloons and the customer that fresh flowers are not a food product. They may contain pesticides, dirt, insect, and other contaminants.
Icake Ballons will not be liable for any special, incidental, punitive, or consequential damage whether foreseen or unforeseen regardless of whether liability is based on breach of contract breached or expressed warranty, expressed negligence or strict liability, tort, or otherwise.
Balloon Waivers
Outdoor Events
Sunshine, wind, and other atmospheric conditions dramatically affect balloon décor. For all
outdoor events, classic balloon décor, deliveries, and balloon sculptures CANNOT be guaranteed
to withstand inclement weather. The customer should have a secondary plan to include an indoor
location for deliveries. All Sales Final.
We use only the highest quality products and make every possible effort to ensure that your
decor will meet or exceed your expectations. However, due to the general nature of balloons, we
cannot guarantee your balloons will remain perfect and intact when used outdoors. Some
balloons will occasionally deflate by wind, rain, rough handling, extreme heat, and other
uncontrollable factors.
All outdoor performances must be conducted in a safe manner and there must be an indoor rain
contingency plan. In the event of cancellation without such a contingency, the payment can be
applied to another day/event within 90 calendar days from the original date of the event, subject
to ICAKE BALLOONS availability. No refunds will be given.
Sun Damage:
In case the sun is shining bright may cause damage to the balloons, it’s worth noting that if balloons are left exposed to the sun, the balloon will start to fade. If it is extremely hot, then the balloon will pop for sure. We are not responsible for any change of weather that happens on the date of an event. Dark-colored balloons (black/ brown/dark blue/dark purple, etc.) attract heat and are subject to pop under
the heat of the sun.
To get the best use out of Helium-filled designs, including bouquets/clusters, arches,
centerpieces, etc. we strongly recommend that you use them INDOORS ONLY. Unfortunately,
their behavior and movement are very unpredictable and they are likely to flop around in the
wind, lose their form, or pop, pop, pop!
BALLOON FLOAT TIME:
Your balloon décor will be designed around the specifications of your event. For example: if you
need a balloon to float for a minimum of 12 hours, we will provide you with a balloon that will float
for 12 hours, and not much more. This applies only to Latex type balloons. Our Mylar/Foil balloon
will stay afloat for up to 1 week on average. The average life of a Latex Helium balloon is less
than 24 hours. If you would like to extend the float time of your balloons please let us know.
We are not responsible for balloons popping/blowing away with outdoor decor.
Safety Warning
DO NOT allow anyone to inhale helium from the filling equipment or from balloons! Inhaling
helium gas directly from high-pressure tanks or inflated balloons can cause dizziness,
drowsiness, loss of consciousness, or other serious injuries. Popping balloons can cause eye or
other injuries. Protective gear, including eye shields, should be worn. The customer is responsible for
supervising all use and preventing all misuse or abuse of helium, balloons, equipment, and
material related to the event.
Customer hereby agrees to hold harmless and without liability, ICAKE BALLOONS. and all
principals, owners, or employees of said Limited Liability Corporation from any of the following:
Helium inhalation or injury from lack of oxygen, slipping on broken balloons, latex allergies,
children or animals having access to balloons before, during, or after events. Not responsible for children putting balloons in their mouths and choking, eye/facial/body injuries from popping balloons, heart attacks from popping balloons, hearing loss due to popping balloons, lesions, abrasions,
suffocation, choking, loss of sight, loss of hearing, dizziness, drowsiness, loss of consciousness,
broken body parts, death, or any other personal or property damage caused or alleged to have
been caused by popping balloons, or damage to swimming pool filtration systems caused by
broken balloons.
Micro foil balloons can be transmitters of electricity. Please avoid releasing them or bringing
them closer to power lines.
Equipment
All equipment brought by Icake Balloons to install your balloon decorations is rented. A time of pick up will be established by Icake Balloons and the customer. The equipment should be in the same conditions as it was left, any lost, damaged, or stolen Icake Ballons rented property will be paid in whole by the customer. This applies to tables, cakestands, tables, chairs, backdrops, balloon art frames, artificial flower decorations, etc...
